Paid Family and Domestic Violence Leave Regulations 2023

There are rules specifying how information about paid Family and Domestic Violence Leave (FDVL) must be reported on payslips and what information must not be included. This is to reduce the risk to an employee’s safety when accessing paid family and domestic violence leave.
If an employee has taken a period of paid FDVL, employers should record this on their payslip in a way that makes the payslip look as close as possible to how it would have looked if the employee had not taken the leave.
Example of paid Family and Domestic Violence Leave (FDVL) in JobBag
An employee is given 5 days FDVL. The leave should be recorded outside of JobBag. Do NOT record the FDVL as a leave event within JobBag, this type of leave is highly confidential and the purpose of the regulations around FDVL are there to deliberately hide this leave.
If you need to show the employee's reduced capacity within the Visual Planning system, set up a recurring meeting for them for the 5 days they will be away, this will show that they have no spare capacity on those days. If a task is assigned to that user, the workload will show as RED on those days.
Generate the employee's payslip as normal, pay them their normal working hours against Ordinary Time Earnings. This will ensure that you meet the Single Touch Payroll (STP) reporting requirements.
Do not record any information about the FDVL on the payslip.
Reporting
FDVL must be reported in STP to align with how you show these amounts on the employee's payslip as:
- part of gross as an employee’s ordinary hours of work or;
- a payment made in relation to the performance of the employee’s work, including (but not limited to) an allowance, bonus or a payment of overtime or;
- upon request by the employee, as an amount paid for taking a period of another type of leave (other than a period of paid family and domestic violence leave).
